Granite State Onsite Wastewater Association (GSOWA) reserves the right to change, add, delete, or otherwise modify content on the Site and these Terms of Use periodically without prior notice.
Acceptance of Terms. By accessing GSOWA.org or registering for membership, you agree to comply with these terms PLEASE READ BEFORE USING THIS SITE
The materials on this website (the "Site") are provided by Granite State Onsite Wastewater Association (GSOWA) as a service to its customers and may be used for informational purposes only. Single copies may be downloaded subject to the provisions below. By downloading any materials from this site, you agree to these terms. If you do not agree to them, do not use the site or download any materials from it.
PAYMENT POLICY. We do not take credit card numbers nor do we store them. All credit card processing is done by the customer on their end at the time of registration through the registration software or when paying their QuickBooks invoices online.
- Events (higher cost events or events with a commitment to a venue): THE ASSOCIATION only refunds event registrations if registration is canceled previous to 7 days before event due to commitments for food and/or to the venue. A $25 Administrative fee is deducted from refunds to major events if cancellation is less than 15 days before event. The refund language is on every registration form—paper and online forms.
- Regular educational trainings (regular class fees): THE ASSOCIATION does refund for trainings, however in most cases a credit on account is offered. If an actual refund is requested, that request is honored in most cases. Chronic offenders (register and never show up) are offered credit on account only and if it happens three times in a year, a $25 administrative fee is charged.
- If a refund is given, it is given in the same format as received: if paid by check, refund is by check to the company or person on the original check.
If paid by credit card, refund is made on the original transaction to that credit card. If for some reason refund happens 30 days or more after original payment is given and we are unable to refund the original credit card transaction, the association sends a check to the original payor/registrant. - Dues are not refundable except in extenuating circumstances (severe illness, death, catastrophic financial situation) however it is not the standard practice to refund dues otherwise.
TERMS OF USE
1. Acceptance. These Terms of Use (these “Terms of Use”) set forth the terms and conditions that apply to your use of the GSOWA Site, including access to and use of the publicly available areas and features of such GSOWA Site (“Public Areas”) and any nonpublic areas or features of such GSOWA Site to which you have been granted access as a Registered User (“Restricted Areas”).
2. Username and Password. A Restricted Area can be accessed by Registered Users who have registered to use such Restricted Area, through a combination of a unique username and password designated to each such Registered User when he, she or it registers to use such Restricted Area. Registered Users are responsible for maintaining the confidentiality of their username and passwords.
3. User Conduct. When using any GSOWA Site, you agree that you will not:
o intentionally or unintentionally, violate any applicable local, state, national or international law or regulation;
o defame, abuse, harass, stalk, threaten, embarrass, cause distress, unwanted attention or discomfort, or otherwise violate the legal rights (including, without limitation, rights of privacy and publicity) of any User or GSOWA member or representative;
o impersonate another person or entity, including, but not limited to, another User or GSOWA member or representative, or communicate under a false name or a name that you are not entitled or authorized to use;
o attempt to “crack,” “hack,” “bomb,” manipulate or otherwise gain unauthorized access to other User accounts, GSOWA servers, GSOWA software, or any areas of GSOWA Sites that are not intended for your access;
o harvest, mine or otherwise collect or store personal information about others, including, without limitation, the e-mail addresses and other content of User profiles; or
o solicit for commercial purposes any other Users, except as expressly authorized by the GSOWA.
o Violation of any of the above may, at any time without prior notice, result in a warning, temporary limitation or suspension or immediate termination of your account or your access to the GSOWA Site, reporting of your conduct to authorities, or legal action, as may be appropriate in the sole discretion of GSOWA.
4. Suspension or Termination of Use or Access. Your failure to follow any requirement of these Terms of Use may result in suspension or termination of access to the GSOWA Sites, without notice, in addition to GSOWA’s other remedies. GSOWA further reserves the right to terminate, without notice and in its sole discretion, any User’s access to or use of any GSOWA Site for any reason. GSOWA shall not have any liability to you or to any third party in respect of any limitation or suspension of your access to any GSOWA Site.
5. Copyright Complaints. GSOWA does not permit copyright infringing activities and other infringement of intellectual property rights on any of the GSOWA Sites, and GSOWA will remove content if properly notified that such content infringes on another’s intellectual property rights.
6. Trademarks. Granite State Onsite Wastewater Association, GSOWA’s logos and other product and service names of GSOWA are trademarks of GSOWA (the “Marks”). You agree not to display, reproduce or otherwise use in any manner the Marks without GSOWA’s prior written permission.
7. LINKS. The linked sites are not under the control of GSOWA and GSOWA is not responsible for the content of any linked site or any link contained in a linked site. GSOWA reserves the right to terminate any link or linking program at any time. GSOWA does not endorse companies or products to which it links and reserves the right to note as such on its web pages. If you decide to access any of the third party sites linked to this Site, you do this entirely at your own risk.
8. No Professional Advice. The information provided on the GSOWA Sites is intended to offer general guidelines. Users are encouraged to consult directly with professional advisors concerning specific matters before making any decision, and GSOWA disclaims responsibility for Users’ reliance on any such information provided on an GSOWA Site.
9. Indemnification. You agree to indemnify, defend and hold GSOWA and each of its officers, directors, employees and agents harmless from and against any and all claims, demands, actions, costs, liabilities, losses and damages of any kind (including attorney's fees) resulting from (a) your use, misuse or abuse of any GSOWA Site or Content, (b) your breach of any provision of these Terms of Use, (c) your use, or the use by any other person, of your username or password for any Restricted Area, (d) your violation of any third party right, including without limitation any copyright, intellectual property or privacy right or (e) any claim that your User Generated Content caused damage to a third party. GSOWA reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you under this paragraph, and you shall not in any event settle any matter without written consent of GSOWA. You will cooperate as fully as reasonably required in GSOWA’s defense of any claim.
10. Electronic Communications. When you visit any GSOWA Site or send emails to GSOWA, you are communicating with GSOWA electronically. You consent to receive communications from GSOWA electronically. GSOWA may communicate with you by email or by posting notices on the GSOWA Sites. You agree that all agreements, notices, disclosures and other communications that GSOWA provides to you electronically satisfy any legal requirement that such communications be in writing.
11. No Third Party Rights. These Terms of Use do not create rights enforceable by any third party.
12. Acknowledgment and Contact Information. You acknowledge that you have read and understand these Terms of Use, and that these Terms of Use have the same force and effect as a signed agreement. If you have any questions about these Terms of Use or this GSOWA Site, or if you are or become aware of or experience any content, activity or communication through or in connection with any GSOWA Site that appears to be in violation of the above, or in violation of any other provision of these Terms of Use, please inform GSOWA of any such violation by sending notification to [email protected].
